You hear me talking constantly of my 5L domains and how I think they have a great risk to return. I realize that it’s only good for $5 to 10,000 a year. I couldn’t live on that but fortunately I don’t have to so I can afford to play around with it. What I have done is taken the $500 domain and worked my way up to buying $10,000 domains. I started with a 5 letter name and sold it. Paid $500 and sold it for $800. Then I bought another name for $1000 and flipped it for $2200. Then I bought a name for $5000 a few weeks ago and flipped it for a little under $9K. Luck and chance? Maybe, but by carefully choosing a name and concentrating on the sale I’ve been able to take $500 and turn it into almost $10K this year. I am now on the prowl for a $10,000 domain to flip

Thus, Courts have framed this as the “who-are-you/what-are-you” test. “A mark answers the buyer’s questions ‘Who are you?’ ‘Where do you come from?’ ‘Who vouches for you?’ But the generic name of the product answers the question ‘What are you?’”

Ultimately, the Court inquires whether consumers who ask for the product by the mark are describing the type of product, (apple) or are seeking the product of a particular producer (Apple).

So, the bottom line is that if you believe that your domain name is "generic" and not subject to attack by a trademark holder either under the UDRP or the ACPA, you need to ask the above questions which will determine if you will win or lose.

Elliot is the founder of Top Notch Domains, LLC, which he started as a grad student at NYU. Later, in 2008, he founded Silver Internet Ventures, LLC, an Internet media company that currently has several developed web properties. Elliot also leads the award winning ElliotsBlog.com, one of the most popular blogs in the domain name industry.

MO:

Stepping away from a successful corporate career is a bold move and one that every entrepreneurial mind dreams of. What was it like to do that and what steps did you take to make it happen? Did you have a backup plan? Any regrets?

Elliot:

I had been with AIG for 2.5 years, and it was just my second job after graduate school. Although I felt that I was doing well at the company, I wasn’t loving what I was doing (direct marketing management of insurance products). This was probably one of the key reasons I continued to pursue my domain business on the side. Just before I resigned in October, I had a couple of large deals lined up for the following January, and I knew just those deals could carry me for a year even if business fell off of a cliff for some reason.

Cloud computing company gets more marketing punch with good domain name.

Cloud.com VP of Business Development Shannon Williams admits that he wasn’t a huge believer in the power of a generic domain name for marketing. But when the opportunity for his company to purchase Cloud.com was discussed internally, he finally came around. Now he is a believer.

I caught up with Williams during HostingCon this week in Austin. He explained some of the benefits of having the company named Cloud.com:

-When Williams meets people and mentions his company, people think they’ve already heard of the company because of its good domain

-People think the company is bigger than it is

-Value for Search Engine Optimization

Putting on his corporate sales hat, Williams says that the domain itself doesn’t add value without a good underlying product. Their product was already selling, and they were doing well because of the product, but he says the domain is like putting some extra gas on a good fire.

It’s certainly more memorable than the company’s old name, VMOps.

I need to be flipping!

Grant it, you need to know when to hold but I need to start flipping domains and developing the goodies that I am passionate about!

Flipping to me, is different than when I first started domaining. I know a lot more now! eBay buyers of the "good" domains are often flippers. Same thing goes for the forum buyers. Flippers that know end users are the right buyers. Sometimes the buyers are "big buyers" and from past contacts.. they become "go to" buyers.

Contacts and your research are KEY!

Example: I have been sitting on this one domain for a little over a year. I was stuck in my "holding" mode and waiting for the buyer to come to me. The domain didn’t make much, if any parked. It’s a strong keyword domain but parking it isn’t going to bring in the traffic. Development is best for the domain due to its keywords.

Sat on it over a year.

Reached into my contacts list today that I knew of a past buyer of a similar domain i sold. I sent out one email to this buyer and a fair price for the domain. SOLD
